Welcome to Ridgecrest Guide. By accessing or using our website at ridgecrestguide.com (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Site.

1. About Ridgecrest Guide

Ridgecrest Guide is a community platform providing information about life in Ridgecrest, California and the Indian Wells Valley. The Site includes a business directory, community club listings, event calendar, real estate listings, dining guides, and other local content.

Ridgecrest Guide is independently operated and is not affiliated with the City of Ridgecrest, Kern County, or Naval Air Weapons Station (NAWS) China Lake.

2. User Accounts

Certain features of the Site require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept responsibility for all activity under your account.
• Notify us immediately at hello@zawolfe.com if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or abusive purposes.

3. User-Generated Content

Users may submit content through the Site, including but not limited to club listings, business submissions, event details, and sign-up form responses (“User Content”). By submitting User Content, you:

• Represent that you have the right to submit the content and that it does not violate any third-party rights.
• Grant Ridgecrest Guide a non-exclusive, royalty-free, worldwide license to display, distribute, and use the content in connection with operating the Site.
• Agree not to submit content that is unlawful, defamatory, harassing, threatening, or otherwise objectionable.

We reserve the right to remove or modify any User Content at our discretion without prior notice.

4. Community Clubs & Events

Ridgecrest Guide allows users to create and manage community clubs and events. Club organizers are responsible for:

• The accuracy of their club and event information.
• Managing their members and sign-up submissions.
• Complying with all applicable laws regarding their club activities.

Ridgecrest Guide is a platform — we do not organize, endorse, or assume liability for any club activities or events listed on the Site. Participation in any club or event is at your own risk.

5. Real Estate Listings

Real estate listings on the Site are sourced from the Southern Sierra MLS and are provided for informational purposes only. Ridgecrest Guide makes no warranty regarding the accuracy, completeness, or timeliness of listing data, including prices, property details, and availability.

The “Request a Tour” feature connects you with a licensed real estate agent (Nicholas Wakley, DRE# 02200707). Any real estate transaction you enter into is between you and the agent/broker — Ridgecrest Guide is not a party to any real estate transaction and does not provide real estate brokerage services.

6. SMS Messaging

By providing your phone number and opting in through a web form on the Site, you consent to receiving SMS messages as described in our SMS Consent & Opt-In Policy. Key terms:

• Message and data rates may apply.
• Message frequency varies. Tour requests generate a single message. Event notifications depend on club activity (typically 0–4 per month per club).
• Reply STOP to opt out at any time. Reply HELP for assistance.
• Consent to SMS is not required to use the Site or to make any purchase.

7. Intellectual Property

The Site and its original content (excluding User Content), features, and functionality are owned by Ridgecrest Guide and are protected by copyright, trademark, and other intellectual property laws. The Ridgecrest Guide name, logo, and design are our trademarks.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as permitted by law.

8. Prohibited Uses

You agree not to use the Site to:

• Violate any applicable law or regulation.
• Impersonate any person or entity, or falsely represent your affiliation.
• Scrape, harvest, or collect data from the Site using automated means without our written consent.
• Submit false or misleading business listings, club information, or event details.
• Interfere with or disrupt the Site's operation or infrastructure.
• Transmit viruses, malware, or other harmful code.
• Spam, harass, or abuse other users.

9. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any information (including real estate listings, business details, or event information) is accurate or complete.

10. Limitation of Liability

To the fullest extent permitted by law, Ridgecrest Guide, its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or goodwill, arising from:

• Your use or inability to use the Site.
• Any content or information obtained from the Site, including real estate listings and business directory information.
• Any actions taken by third parties, including club organizers, real estate agents, or business owners.
• Any unauthorized access to your account or data.

11. Indemnification

You agree to indemnify and hold harmless Ridgecrest Guide, its owners, operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Site, your User Content, or your violation of these Terms.

The Site may contain links to third-party websites and services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party services is governed by their respective terms and policies.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Kern County, California.
